Terms of Service

Effective Date: April 30, 2026

1. ACCEPTANCE. By accessing or using lepsychic.com (the "Site") or any services offered by LePsychic LLC ("LePsychic," "we," "us," or "our"), you ("User," "Client," "you") agree to these Terms of Service ("Terms"), our Privacy Policy, Refund Policy, Disclaimer, Acceptable Use Policy, and any other posted policies, all incorporated by reference. If you do not agree, do not use the Site or Services.

2. ELIGIBILITY. You must be at least eighteen (18) years old and legally able to enter a binding contract in your jurisdiction. By using the Site you represent and warrant you meet these requirements. We may require age verification at checkout and account creation.

3. SERVICES. LePsychic offers spiritual entertainment services including but not limited to psychic, tarot, astrology, mediumship, numerology, and energy readings delivered by independent contractor advisors ("Advisors"), plus retail products, memberships, digital content, and gift cards. All services are provided for entertainment purposes only (see Disclaimer).

4. ACCOUNT. You are responsible for all activity under your account, for maintaining confidentiality of your credentials, and for providing accurate information. We may suspend or terminate accounts for any violation of these Terms, fraudulent activity, chargebacks, abusive conduct toward Advisors or staff, or misuse of the Services.

5. PAYMENT AND BILLING. Live session readings are billed per minute at the rate shown on the Advisor's profile ($3.33, $5.55, $8.88, or $11.11 per minute). Flat-rate written or pre-booked readings are charged at posted rates ($44, $88, or $177). A pre-authorization hold is placed on your payment method at session start; final capture occurs at session end based on actual minutes used, with a one-minute minimum. If a session is interrupted by technical failure on our side, unused time is credited. You authorize LePsychic and its payment processor (Stripe) to charge your payment method for all amounts owed.

6. REFUNDS. Refund eligibility is governed by our Refund Policy. Sessions that have started are not refundable for quality-based reasons; refunds are limited to sessions not started, billing errors, or duplicate charges. Chargebacks filed without prior contact to support may result in account termination.

7. MEMBERSHIPS AND SUBSCRIPTIONS. Paid memberships auto-renew at the interval selected until cancelled. Cancellation is available in your account dashboard with a single click (California ARL compliant). Cancellation takes effect at the end of the current billing period. No partial-period refunds. Gift cards are non-refundable and do not expire except where required by law.

8. USER CONDUCT. You agree not to: (a) harass, threaten, or abuse Advisors or staff; (b) request services outside posted scope (e.g., medical diagnosis, legal advice, financial investment advice, guaranteed outcomes); (c) record sessions without written consent; (d) reverse engineer or scrape the Site; (e) use the Services for illegal purposes; (f) create multiple accounts to exploit promotions; (g) solicit Advisors off-platform. Violations may result in immediate termination without refund.

9. INTELLECTUAL PROPERTY. All Site content, trademarks, logos, blog posts, editorial, product imagery, and advisor-produced session materials are owned by LePsychic LLC or licensed to us. You receive a limited, revocable, non-exclusive, non-transferable license to use the Site for personal, non-commercial purposes only. No right to copy, redistribute, or create derivative works is granted.

10. USER CONTENT. If you post reviews, testimonials, comments, or other content, you grant LePsychic a worldwide, perpetual, royalty-free, sublicensable license to use, display, reproduce, and adapt that content for marketing and operations. You represent the content is yours and lawful to post.

11. ADVISOR RELATIONSHIP. Advisors are independent contractors, not employees or agents of LePsychic. Advisor statements, readings, and opinions are their own. LePsychic facilitates the connection and handles billing; we do not guarantee Advisor availability, accuracy, or outcomes.

12. DISCLAIMERS. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. READINGS ARE FOR ENTERTAINMENT PURPOSES ONLY. NO READING IS A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, LEGAL, FINANCIAL, OR OTHER LICENSED ADVICE. YOU ASSUME ALL RISK OF RELIANCE.

13. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEPSYCHIC, ITS OFFICERS, OWNERS, EMPLOYEES, CONTRACTORS, AND ADVISORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO LEPSYCHIC IN THE NINETY (90) DAYS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

14. INDEMNIFICATION. You agree to indemnify, defend, and hold harmless LePsychic and its affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

15. DISPUTE RESOLUTION - BINDING ARBITRATION AND CLASS ACTION WAIVER. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Yavapai County, Arizona, in English. YOU AND LEPSYCHIC WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Small-claims court actions are permitted. You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing info@lepsychic.com with subject "Arbitration Opt-Out."

16. GOVERNING LAW. These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws principles.

17. MODIFICATIONS. We may update these Terms at any time. Material changes will be posted with a revised Effective Date and notified via email or on-site banner. Continued use after changes constitutes acceptance.

18. TERMINATION. We may suspend or terminate your access for any breach. Sections regarding Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and any other provision that by its nature should survive, shall survive termination.

20. SMS / TEXT MESSAGING TERMS. LePsychic sends SMS messages only to users who have explicitly opted in. Messages may include appointment confirmations, reminders, session updates, account verification, support replies, and wallet/payment alerts. Message frequency varies based on account activity. Reply STOP to unsubscribe and HELP for assistance. Message and data rates may apply. Carrier liability is not assumed. Consent to receive text messages is not a condition of any purchase.
